Personal Data Privacy Policy

This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) is a public Agreement concluded between the owner of the website Limited Liability Partnership ASP Holding (hereinafter referred to as the Seller) and the Customer in accordance with Article 387 of the Civil Code of the Republic Kazakhstan, based on the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”, applies to information containing personal data of Customers that the website https://asp.club/ (hereinafter referred to as the website) can receive about Customers in time of their use of the website

1. TERMS AND DEFINITIONS

Parties - Seller and Customer.

Seller - ASP Holding LLP. Certificate of VAT registration series 60001 No. 1228848 dated 05/03/2022.

Customer - is an individual or legal entity who orders and pays for certain goods or services from a supplier or performer.

Agreement - this document with appendices, additions.

Product - Services and Products published on the Seller's website, in the form of tickets, accommodation numbers, parking spaces and more.

RK - Republic of Kazakhstan.

Personal Data - information relating to a specific subject of personal data or determined on their basis, recorded on electronic, paper and (or) other material media.

Non-personal data - information that is automatically transmitted while the Buyer is viewing advertising blocks and when visiting pages on which the system's statistical script is installed: address of the requested page, cookie information, IP address, browser information, referrer (address of the previous page), access time.

Collection of personal data - actions aimed at obtaining personal data.

Personal data processing - actions aimed at accumulating, storing, changing, supplementing, using, distributing, depersonalizing, blocking and destroying personal data.

Personal data protection - a set of measures, including legal, organizational and technical, carried out for the purposes established by the Law of the Republic of Kazakhstan “On Personal Data and Their Protection.”

Web service - all services available for use on the site http://asp.club and subdomains.

2. SUBJECT OF THE PRIVACY POLICY

2.1. This Privacy Policy establishes the Seller's obligations to non-disclose and ensure a regime for protecting the confidentiality of personal data that the Buyer provides at the request of the Seller when registering on the Web service and/or when placing an Order for the purchase of Products.

2.2.2. date of birth;

2.2.4. email address (e-mail);

2.2.5. shipping address;

2.3. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-distribution, except for the cases provided for in clause 4.3.2. and clause 4.4. of this Privacy Policy.

3. PURPOSE OF COLLECTION AND PROCESSING OF BUYERS' PERSONAL DATA

3.1. The Seller collects, processes and stores only those personal data that are necessary to provide Services and/or purchase by the Buyer of Products from the Web service catalog.

3.2. The Seller uses the Buyer's personal data for the following purposes:

3.2.1. identification of the Buyer for placing an Order and/or concluding a Service Agreement;

3.2.2. processing and receiving payments from the Buyer;

3.2.3. delivery to the Buyer;

3.2.4. providing the Buyer with effective customer support;

3.2.5. providing the Buyer with a set of personalized Products;

3.2.6. communications with the Buyer, including sending notifications, requests and information regarding the use of the Services, the provision of services, as well as the processing of requests and Applications from the Buyer;

3.2.7. improving the quality of the Services, ease of use, developing new Services;

3.2.8. informing the Buyer about ongoing events and promotions;

3.2.9. conducting statistical and other research based on non-personal data, as well as optimizing advertising messages;

3.3. The Seller is not responsible for the information provided by the Buyer on the website in a publicly accessible form.

3.4. The Seller is not responsible for losses that the Buyer may incur as a result of the fact that his login and password became known to a third party

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The buyer must:

4.1.1. provide information about personal data necessary to use the Web service;

4.1.2. change, supplement the information provided if incorrect data is detected when using the Web service.

4.2. The buyer has the right:

4.2.1. to access and edit information about personal data at any time through the web interface provided within the services.

4.3. The seller must:

4.3.1. use the information received solely for the purposes specified in section 3 of this Privacy Policy;

4.3.2. ensure that confidential information is kept secret, not disclose transferred personal data without the Buyer's prior written permission, with the exception of data transfer for the purpose of fulfilling the Buyer's Order (courier services, postal organizations, banks, etc.), and also authorized state bodies of the Republic of Kazakhstan in the manner established by the legislation of the Republic of Kazakhstan;

4.3.3. take precautions to protect the confidentiality of the Buyer's personal data in accordance with the procedures generally used to protect such information.

4.4. The Seller has the right to provide access to the collection and analysis of non-personal data of Buyers to third parties for the purposes of statistics and optimization of advertising messages. The use of non-personal data by third parties is governed by their own privacy policies, and the Web service is not responsible for their use.

5. OTHER TERMS

5.1. The Buyer's use of the Web service means his unconditional agreement with this Privacy Policy and the terms of processing of the Buyer's personal data by the Seller.

5.2. In case of disagreement with the terms of the Privacy Policy, the Buyer must stop using the Site, Web service.

5.3. This Privacy Policy applies only to the Web service site https://asp.club/ and subdomains. The Web service is not responsible for third party sites that the Buyer can access via links available on the Web site service

5.4. The Seller, due to the specifics of the method of obtaining information, does not verify the accuracy of the personal data provided by the Buyer and does not monitor its relevance. However, the Seller assumes that the Buyer provides reliable personal data and keeps this data up to date. All The Buyer bears responsibility, as well as possible consequences, for providing false or irrelevant personal data.

5.5. Disabling Cookies may result in the inability to access parts of the Web Service site that require authorization.

5.6. The web service collects statistics about the IP addresses of its Buyers. This information is used to identify and solve technical problems, to control the legality of financial payments.

5.7. The current legislation of the Republic of Kazakhstan applies to this Privacy Policy and the relationship between the Buyer and the Seller.

5.8. The Seller reserves the right to unilaterally change this Privacy Policy to further improve the security system in accordance with the current legislation of the Republic of Kazakhstan.
